Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Cannpliance, a product of Elevated States Consulting, LLC (“we,” “us”). By creating an account or using the service, you agree to these Terms.
1. The service
Cannpliance provides software tools that compare hemp product packaging and Certificates of Analysis against published state and federal regulations, and related informational resources.
2. Not legal advice
Cannpliance provides regulatory information for general informational purposes only and does not constitute legal advice. Hemp and cannabis regulations change frequently and vary by jurisdiction. Our output is not a certification, guarantee, or assurance of compliance. You are responsible for your own compliance decisions and should consult a qualified attorney before making labeling, formulation, or distribution decisions.
3. Accounts & eligibility
You must provide accurate account information and are responsible for activity under your account. You must be at least 18 and using the service for business purposes in the United States. Do not share your login; access may be provisioned per seat.
4. Acceptable use
- Do not attempt to circumvent usage limits, rate limits, or access controls.
- Do not use automated means to submit requests at volume, or otherwise abuse the service.
- Do not resell, sublicense, or redistribute output except under a separate written partner or channel agreement.
- Do not upload content you do not have the right to submit.
5. Fees & payment
Some features are free and others are paid. Where paid, fees, billing terms, and any usage limits are presented at the point of purchase and processed by a third-party payment processor. You are charged for a report only once it is generated and delivered to your account. Unused prepaid account credit is refundable within 30 days of purchase; completed reports and credit already spent are non-refundable except where required by law. Prepaid credits are service credits (not cash), redeemable only for Cannpliance reports, and do not expire. See our Refund & Cancellation Policy for details.
6. Intellectual property
The service, including its software, content, and design, is owned by Elevated States Consulting, LLC and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the service under these Terms.
7. Your content
You retain all rights to the labels, COAs, and other materials you submit. As described in our Privacy Policy, we do not store your uploaded files. The reports you generate are stored in your account so you can access them; you can delete your reports at any time.
8. Disclaimers
The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the regulatory information is complete, current, or error-free.
Our analyses are generated in part by automated AI systems and may be incomplete, inaccurate, or contain errors, and may change as AI models or regulations change. You are solely responsible for independently reviewing and verifying any output before relying on it.
9. Limitation of liability
To the maximum extent permitted by law, Elevated States Consulting, LLC will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss arising from your reliance on the service. Our total liability for any claim will not exceed the amount you paid us in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your use of the service or violation of these Terms.
11. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles.
12. Changes
We may modify these Terms; material changes are reflected by the “Last updated” date above. Continued use after changes constitutes acceptance.
